## Article

HSE enforcement commonly follows patterns. The same gaps show up again and again in notices and inspector guidance.

The most common DSEAR failings

1) Risk assessment exists, but it’s not “suitable and sufficient”

A DSEAR assessment that doesn’t properly identify substances, scenarios, ignition sources, or real controls is a liability. DSEAR requires assessment before work with dangerous substances.

2) Poor segregation and excessive quantities in process areas

HSE notices regularly focus on failure to separate dangerous substance process from storage and to minimise quantities, because it drives escalation risk.

3) Zoning is missing, wrong, or not applied

Under-zoning creates a false sense of safety, over-zoning creates chaos. For dust, zoning and hazardous area classification can be overlooked entirely, especially in food and milling.

4) Incorrect equipment in hazardous zones

HSE guidance is explicit that zoned areas must be protected from ignition sources and equipment should be selected appropriately.

5) Inspection, verification, and maintenance are weak

An enforcement notice example highlights ignition-source control failures and inspection gaps where ATEX equipment hadn’t been inspected for more than five years in a zoned area containing flammable ethanol.

6) Static electricity ignored

Static is routinely underestimated, particularly with powders, plastic packaging, belt drives, filter changes, and people movement.

7) Poor control of non-routine work

Hot work, maintenance, and contractor activity are common ignition pathways. Your DSEAR should explicitly cover foreseeable abnormal activities.

What inspectors tend to probe

HSE inspector documents emphasise zoning, equipment selection, marking zones, and verifying safety before plant is used.

How to reduce your enforcement risk quickly

- Verify whether your zoning is correct and current
- Check equipment suitability against zones (including maintenance activities)
- Confirm inspection frequencies and evidence
- Reduce dangerous substance quantities in process areas
- Make actions measurable and owned, not “consider doing X”

If you have had a near miss or a visit is likely, we can do a focused DSEAR health check and give you a short action list that reduces serious risk and demonstrates control.
