## Article

Discovering that your equipment is not fully PUWER-compliant is not unusual. It is, in fact, one of the most common situations we encounter at Safety Management Ltd. Businesses operate under real-world pressures — production targets, tight margins, limited budgets, and legacy equipment — and compliance can gradually slip without anyone making a conscious decision to let it happen.

The challenge is what you do next. Shutting down production to address every compliance issue simultaneously is rarely practical. But continuing to operate non-compliant equipment carries serious legal, financial, and human risks. The key is to take a structured, risk-based approach that addresses the most critical issues immediately while planning a realistic programme of improvement.

Step 1: Acknowledge the Situation

The first step is to be honest about where you stand. Denial or avoidance only increases risk. If you suspect that your PUWER compliance is not where it should be, commission an independent assessment to establish the facts. An external expert can provide an objective view that is free from internal blind spots and political pressures.

It is worth noting that the HSE has acknowledged that having a documented plan showing where your organisation has come from in terms of safety, and where it plans to be, can have a mitigating effect on fines in the event of prosecution. Demonstrating that you identified your issues and were actively working to address them is significantly better than being found to have ignored them.

Step 2: Prioritise by Risk

Not all compliance gaps carry the same level of risk. A machine operating without guarding on a dangerous part presents an immediate risk of serious injury. An overdue inspection on a low-risk piece of equipment is still a compliance issue, but it is not as urgent.

Prioritise your remedial actions based on the severity of the potential outcome and the likelihood of harm occurring. Issues that could cause fatal or serious injury should be addressed immediately, even if this means taking equipment out of service. Issues that present lower risk can be programmed into a planned improvement schedule.

Step 3: Implement Interim Controls

While permanent solutions are being planned and implemented, interim control measures can be put in place to reduce risk without stopping production entirely. These might include additional supervision, temporary physical barriers, restricted access procedures, enhanced pre-use checks, or reduced operating speeds.

Interim controls must be documented, communicated to all affected workers, and monitored for effectiveness. They are not a substitute for permanent solutions, but they demonstrate active management of the risk while permanent measures are being prepared.

Step 4: Plan and Schedule Permanent Fixes

Permanent solutions should be planned around production schedules wherever possible. Many compliance improvements — such as installing upgraded guarding, fitting new emergency stops, or upgrading control systems — can be carried out during planned maintenance shutdowns, shift changes, or lower-demand periods.

Work with your engineering team and external specialists to scope the work required, source materials and components, and schedule installation to minimise disruption. A well-planned improvement programme can address significant compliance gaps with minimal impact on productivity.

Step 5: Update Documentation and Training

As changes are made, update your risk assessments, safe systems of work, maintenance schedules, and inspection procedures to reflect the new arrangements. Ensure all affected operators are informed of the changes and receive any additional training required.

Documentation is particularly important during a period of improvement. It provides evidence that you are actively managing the transition from non-compliance to compliance, and it ensures that everyone in the organisation understands the current requirements.

Step 6: Verify and Maintain

Once permanent solutions are in place, verify that they are effective. Carry out post-modification inspections to confirm that the changes achieve the intended outcome. Then build the new arrangements into your ongoing maintenance and inspection programme to ensure compliance is maintained.
