It is one of the most frequently asked questions in workplace health and safety: does PUWER apply to older equipment? The answer is unambiguous. Yes. The age of a piece of equipment does not exempt it from the requirements of the Provision and Use of Work Equipment Regulations 1998. In many cases, older equipment actually demands more rigorous assessment and management than newer machinery.
This matters because a significant proportion of UK workplaces — particularly in manufacturing, engineering, agriculture, and logistics — rely on equipment that was manufactured and installed before PUWER came into force. Some of this equipment predates even the original 1992 regulations. And much of it is still operating every day, presenting risks that may never have been properly assessed.
What the Law Actually Says About Older Equipment
PUWER applies to all work equipment, regardless of when it was manufactured or purchased. The HSE is explicit on this point: the definition covers any machinery, appliance, apparatus, tool, or installation for use at work, including new, existing, and second-hand equipment.
Regulation 10 of PUWER requires that work equipment conforms with any essential requirements of relevant product supply legislation. For machinery manufactured after 1 January 1995, this typically means compliance with the Machinery Directive and appropriate CE or UKCA marking. However, for pre-1995 machinery, the employer still has an obligation to ensure the equipment meets equivalent safety standards — specifically, the requirements set out in PD 5304 (Guidance on the safe use of machinery), which reflects the safety principles that applied to older equipment.
In practical terms, this means that even if your machine was built in 1985 and never required a CE mark, PUWER still requires you to ensure it meets the same fundamental safety standards as modern equipment. Guards must be adequate. Controls must be effective. Emergency stops must function. Isolation must be possible. Training must be provided.
Why Older Equipment Presents Greater Risk
Older equipment tends to present elevated risks for several reasons. Safety standards have evolved significantly since many older machines were designed. Features now considered essential — such as interlocked guards, light curtains, dual-channel safety circuits, and monitored emergency stops — were not standard decades ago.
Wear and deterioration are inevitable with age. Components fatigue. Guards corrode. Wiring degrades. Control systems become unreliable. The manufacturer may no longer exist, making it difficult to source spare parts or obtain technical support.
Modifications and adaptations over the years can introduce new hazards. A machine that was safe in its original configuration may not be safe after decades of incremental changes, none of which were formally assessed.
And critically, documentation tends to deteriorate over time. Original manuals, risk assessments, maintenance records, and technical files may have been lost. Without this documentation, it is much harder to demonstrate compliance.
Second-Hand Equipment: The Hidden Trap
When a business purchases second-hand equipment, it becomes “new” work equipment under PUWER from the date it is brought into use by the purchasing company. This is a critical point that many businesses overlook. The HSE is clear: anyone supplying second-hand equipment for use at work must ensure, so far as reasonably practicable, that it is safe. The term “sold as seen” cannot be used to avoid these legal responsibilities.
If you acquire second-hand machinery, a full PUWER assessment should be carried out before it enters service. Do not assume that because it was previously in use elsewhere, it is compliant.
What Should You Do?
If your operation includes equipment that was manufactured before 1995, or any second-hand equipment, the answer is straightforward: commission a PUWER assessment. This assessment should evaluate the equipment against current safety standards, identify all hazards, review existing control measures, and recommend any modifications or upgrades needed to achieve compliance.
In many cases, the modifications required are proportionate and cost-effective — upgraded guarding, improved emergency stops, better isolation provisions, or enhanced training. The cost of these improvements is invariably a fraction of the cost of a prosecution, a compensation claim, or worst of all, a serious injury.
